Terms of service

1. INTRODUCTION

These terms govern using byalcapone.shop and purchasing goods through the store. References to we, us, and our concern the business operating byalcapone.shop. Questions should be sent to info@byalcapone.shop.

Read these terms with the Return and Refund Policy, Shipping and Delivery Policy, Privacy Policy, and Legal Notice. Purchase-specific information disclosed before checkout is relevant to the sales contract. Mandatory consumer law takes priority over conflicting wording.

2. ELIGIBILITY AND LAWFUL USE

You must have legal capacity to place the order or appropriate authorisation. Provide accurate information for payment, communication, and delivery. Do not impersonate someone else or use payment credentials without permission.

Use the store lawfully. Do not introduce malicious software, attempt unauthorised access, interfere with checkout or security, or engage in fraudulent activity. Responses to misuse will be proportionate and will not extinguish lawful remedies for genuine purchases.

3. PRODUCT INFORMATION

Review the description, selected option, measurements, materials, compatibility, care instructions, and relevant restrictions before ordering. Lighting and screens can affect images, but goods must still conform to their description and statutory quality requirements.

Specific origin, certification, warranty, performance, or affiliation claims apply only where clearly provided for the relevant product. Placing an item in a basket does not reserve stock unless an express reservation arrangement is offered.

We may correct listings for future orders. Changes do not automatically alter accepted purchases. A material issue affecting your order will be explained so that an appropriate lawful solution can be agreed.

4. PRICES AND CHARGES

Review the selected product price and final total before submitting an order. Prices for UK consumers include applicable taxes where required. Permitted additional charges must be disclosed before payment, and optional payments require the appropriate agreement.

All orders receive free standard shipping. We do not add a standard delivery payment after checkout. Separate optional services, if offered, are governed by their disclosed price and conditions. Your payment provider's currency conversion terms may separately apply where relevant.

If an obvious material pricing error is identified before acceptance, we may decline the order and refund a collected payment. An issue after acceptance will be explained and resolved consistently with law rather than through an automatic additional charge or unilateral price increase.

5. ORDER SUBMISSION AND ACCEPTANCE

Submitting an order is an offer to buy the selected goods on the disclosed terms. An automatic acknowledgement confirms receipt, and is not acceptance unless it expressly says otherwise. Acceptance occurs when we send a dispatch confirmation or express acceptance message, whichever happens first.

Payment may be authorised or collected before acceptance according to checkout arrangements. If we cannot accept or fulfil the order, we will notify you and promptly release the authorisation or refund collected payment. Relevant reasons can include unavailable stock, a disclosed delivery restriction, a material listing error, or a substantiated payment or security issue.

We do not reserve an unrestricted right to cancel accepted orders arbitrarily. Cancellation must be consistent with the contract and applicable law. Keep your order confirmation and purchase information for reference.

6. PAYMENT AND SECURITY

Available methods appear at checkout. Use an authorised method and accurate information. Payment services may perform their own authorisation or security checks. Never email complete card numbers, security codes, or passwords to us.

If clarification is necessary, we may contact you using the order details. We will not demand an undisclosed surcharge to answer an ordinary enquiry. A payment dispute is addressed through the relevant process without removing statutory rights.

7. DELIVERY AND RISK

Usual processing is 1–2 working days. Estimated total delivery is 15–20 calendar days from order placement, including processing. Working days exclude weekends and public holidays. This period is an estimate unless an express commitment is agreed.

Dispatch and tracking information is provided by email where available. Scans may be delayed, and separate parcels may have separate references. Contact info@byalcapone.shop about late or missing goods. We remain responsible for duties owed to you and do not make a carrier claim your only remedy.

Risk normally remains with us until you or your nominated recipient physically receives the goods, except where the law provides otherwise for a carrier independently commissioned by you. Disputed delivery is assessed on the facts rather than a tracking entry alone.

8. CHANGES AND LATE DELIVERY

Contact us promptly about cancellations or address corrections. An in-transit shipment may not be alterable, but this does not remove statutory cancellation rights. We will explain practical available arrangements.

Delivery must occur within the agreed period and, where no period is agreed, within the legal default period unless another lawful arrangement is made. If an applicable deadline is missed, you may normally require delivery within an additional reasonable period and terminate if delivery still fails. Immediate termination may be available where timely delivery was essential, delivery is refused, or the law otherwise permits it.

Disruption does not authorise us to retain payment indefinitely. We will provide updates and legally required cancellation or reimbursement remedies. Further details appear in the Shipping and Delivery Policy.

9. CANCELLATION, RETURNS, AND QUALITY RIGHTS

Eligible goods have a 30-day voluntary return period. UK consumers also generally have 14 days after receiving most online goods to notify cancellation, followed by another 14 days to return them. Genuine statutory exceptions can apply to particular goods.

Goods must be of satisfactory quality, fit for purpose where legal conditions apply, and as described. Remedies may include rejection, repair, replacement, a price reduction, or refund. Voluntary requirements concerning unused condition, packaging, or a 30-day request do not reduce statutory remedies.

No restocking fee is charged. Refunds normally use the original method. We aim to initiate eligible refunds within seven calendar days after applicable conditions are met while respecting mandatory deadlines. Bank posting time can affect when the credit appears. Detailed timing and return-cost rules are in the Return and Refund Policy.

10. PROMOTIONS AND CUSTOMER CONTENT

Promotions follow clearly disclosed terms concerning eligibility, expiry, and combinations. Comparison prices must be genuine and consistent with applicable law. Undisclosed conditions will not be introduced after purchase.

If submission or review features are available, provide only content you have rights to submit. Do not publish misleading reviews, unlawful material, or another person's private information. Submission for publication permits reasonable use to display and administer that feature; you retain rights not needed for that purpose.

11. INTELLECTUAL PROPERTY AND EXTERNAL SERVICES

Content and design may be protected by rights belonging to us or other rights holders. Ordinary browsing and purchasing are permitted. Commercial copying or distribution needs relevant permission unless legally allowed. Report suspected infringement with the page location and supporting information to info@byalcapone.shop.

Third-party names in a listing do not alone establish endorsement or affiliation. External services have their own terms for their independent activities. Those terms do not remove our duties concerning goods we sell or disclosures we make.

12. ACCOUNTS AND PRIVACY

Where accounts are available, protect your credentials and report suspected misuse. Access may be reasonably restricted to address a substantiated security issue. Existing orders, refunds, and statutory requests must still be addressed.

The Privacy Policy explains personal information handling. Accepting sales terms is not blanket consent to optional advertising, analytics, or marketing. Necessary purchase communications may be sent using the details you supplied.

13. LIABILITY

Nothing excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any liability or consumer right that cannot lawfully be excluded or limited.

Where we breach the contract or fail to exercise required care, we are responsible for loss that is a foreseeable result. Loss is foreseeable where it is an obvious consequence or was contemplated when the contract was made. There is no universal purchase-price liability cap overriding mandatory protections.

These terms concern ordinary consumer purchases. Loss connected to an undisclosed business use is considered according to applicable law and circumstances. A separate business arrangement must be expressly agreed rather than inferred from consumer checkout.

14. INTERRUPTIONS AND EXTERNAL EVENTS

Maintenance or security work can interrupt website access. We aim to address problems reasonably. An interruption does not erase an accepted contract or refund obligation.

Where events outside reasonable control affect fulfilment, we will explain the issue and take reasonable steps to reduce its impact. Statutory remedies for late delivery, cancellation, or reimbursement remain available; no clause authorises unlimited delay without a remedy.

15. COMPLAINTS, COURTS, AND CHANGES

Email info@byalcapone.shop with the facts and requested outcome. We will review the complaint and relevant evidence. Where legally required after an unresolved complaint, we will provide applicable alternative dispute resolution information, including whether we must or are willing to participate.

These terms operate consistently with UK consumer protections. Mandatory protections and court access under applicable jurisdiction rules remain available. We do not require compulsory private arbitration or exclusive use of a distant court.

Updates apply to future purchases unless changes to an existing contract are expressly agreed or legally required. Unenforceable provisions do not remove mandatory protections; remaining provisions continue only where legally possible.
